HomeMy WebLinkAbout2478 Forfeiture (a) If a Participant is discharged from~employment penalty for willfully damaging the property or business for certain of the Employer, other persons in the employ of actions against the Employer, or any customer of the Employer, the Employer or for proven dishonesty in any form directed against associates the Employer, other persons in the employ of the Employer, or any customer of the Employer whether or not such dishonesty results in actual loss to any such party; or for diwlging any of the Em- ployer's methods or forms, business practices or trade secrets, any right~or cla~m of such Parti- cipant or his Beneficiary to or in respect of, any benefit under the Plan, or to any interest in any assets held in the Trust Fund, shall be for- feited and terminated. Restrictive (b) Any Participant engaged as an executive, super- covenant visor, developer or in any vital position of forfeitures responsibility who retires or otherwise terminates his employment with the Employer shall not be en- titled to any benefits under the Plan if within ; two (2) years from tY~e date of termination of ~ employment: ~ • ~ (1) he communicates or divulges, directly or in- = directly, to any person, association, firm ~ or corporation, any of the Employer's trade ~ secrets, business practices, procedures, de- ~ signs, suppliers, methods or forms; or he, directly or indirectly, solicits, canvasses ~ - or aids any person, association, firm or ~ corporation to solicit or canvass the trade ~ custom, business or patronage of any customer ~ of the Employer for himself or any other per- ~ son, association, firm or corporation; or ~ ~ (2) he, directly or indirectly, under any cir- cumstances whatsoever, engages in or becomes ~ interested as a sole proprietor, partner, ~ stockholder, director, officer, agent, con- ~ sultant, advisor or an employee in a sales ~ or supervisory capacity, whether for compen- ~ sation or otherwise, in any person, associa- tion, firm, corporation or business entity ~5 .
