defendants have been duly and properly served constructively by
publication of notice of suit and that none of said defendants
have filed or served any paper in this cause or made any appear- ~
ance within the time set forth in the notice of suit, and that
the plaintiff is unable to determine whether any of said

i defendants are in the military service of the United States of

` America or are incompetent or whether any of said defendants,
