A contract was signed for Che purchase of a new automobile, Plaintiff
alleges that the contract price differed from that of the sticker price on
the automobile by a cleaning fee. The automobile agent teatified that all new
car purchases are charged with this fee. The plaintiff further atated that at
the time of closing he noticed the change in base price but went ahead with
the deal. A contract in writing may be rescinded only on grounda of fraud,
duresa, undue influence and mistake. None of theae~factors are present. It is
~herefore, upon
CONSIDBRATION, O1tDERED and ADJUI)GED that the plaintiff shall go hence
without day and take nothing by this cause.
