~1 WHEREAS, by Quit Claim Deed from Hattie E. Chamberlin,
~sv~4~ a widbw, dated October 28, 1938, and recorded in Deed Book
~j ~ 82 at page 234 of the public records of St. Lucie County,

= Florida, the St. Lucie County Sanitatary District acquired

a right-of-way or easement through the lands of the said
1 Z i Hattie E. Chamberlin in Section 26, Township 34 South,
__.`;'"~E Range 40 East, to be used for the purposes stated in the act
creating said district, and more particularly described as

follows:
A strip of land 100 feet wide extending Easterly
; from the low water mark of the East shore of the ;3°j
Indian River at a right angle to the shore line
~ and running 100 feet distant therefrom. The
~ Western boundary of said right of way or ease-
~ ment being the low water mark of the Indian
~ River on the Eastern shore thereof, and the
~ Eastern boundary being 100 feet distant there-
~ from and parallel thereto.
~ WHEREAS, said quit claim deed provides that if the
easement therein granted ceases to be used for pest control
~ it will revert to the grantor therein, and in the event the
~ area is developed by the fee owner by being filled and excavated =
~ so that it will cease to be a breeding ground for pests, then said
~
easement will cease and determine; and
WHEREAS, party of the second part is now the fee owner of
that portion of Government Lots 4 and 5 of Section 26, Township
34 South, Range 40 East, situate within that certain parcel of
