THIS INDENTURE, made this Z~ day of ~~~+'c h. 19?4. by
and between LUCILLE V, COSTA, INC. . a Florida corporation. Mortgagor.
and_ hereinafter so designated and BANKERS TRUST COMPANY, a New York
banking corporation, Mortgagee. and hereinafter so designated:
WHEREAS~ Mortgagor is justly indebted to Mortgagee in the principal
sum of One Million Dollars ($1, 000, 000. 00)~ as evidenced by a certain
promissory note of even date herewith. executed by Mortgagor and delivered ~
to Mortgagee and by reference being made a part hereof to the same extent
as though set out in full herein, the full payment of which is due not later
than one (1) year ~rom date.
NOW, THIS INDENTURE WITNESSETH: ~ That Mortgagor, to better
secure the payment of the principal sum set out in said promissory note, and
interest thereon, and in consideration thereof, and for other valuable considera-
tions. has granted, bargained and sold and by these presents does grant, bargain
and sell to Mortgagee and to its successors and assigns forever, all that certain
parcel or piece of land lying and being in St. Lucie County, Florida, more
particularly described on the Exhibit "A" hereto attached and made a part hereof,
herein called the "Pcemises" as to all or any portion khereof.
TOGETHER, with all sewerage treatment and collection facilities
designed to serve La Sagra Condorninium and the surrounding area including
all appurkena.nces thereto or serving same and all equipment used in connection
therewith now or hereafter located in or about the above described premises
and all additions thereto and all renewals, replacements and replenishments
thereof.
TOGETHER, with any and all furniture~ furnishings, fixtures and equip-
ment including stoves and refrigerators (but excluding equipment in commercial
stores, if any, owned by tenants) no~~v or hereafter located in and about the above
described premises and all additions thereto and all renewals, replacements and
replenishments thereof; and including as a part of the realty~ heating and air
conditioning units, equipment; machinery~ ducts and conduits whether detachable
or not, now or hereafter located in and about the above described premises,
including all additions thereto and all renewals, replacements and replenishments
- thereof; and
TOGETHER, with all and singular the tenements, hereditaments and
appurtnenances thereto belonging or in anywise thereunto appertaining and the
rents, issues and profits thereof, and also all the estate, right, title, interest
and all claim and demand whatsoever, as well in law as in equity, of Mortgagor
in and to the same, including but not limited to:
NO FLORIDA DOCUMENTARY STAMPS ARE AFFIXED HERETO OR TO THE
NOTE SECURED HEREBY, NONE BEING REQUIRED SINCE THE NOTE K'AS
