collect and receive all ren~s, issues and profits thereof, i::- '
eluding those past due as well as those accruing thereafter, and
(b) t4ortgagee shall be entitled, as a~ matter of strict
right and without regard to the value or occupancy of the secur-
~ty, to have a receiver appointed to enter upon and t~ke possPS-
sion of the prer!~ises, collect the rents and profits ther~`_rom and
apply the same as the court may direct, such receiver to have all
the rights and pocaers permitted urider the la~~s of Florida. ~
In either of such case Mortgagee or the~receiver may ~lso
take possession of, and for these purposes use, any and all per-
sonal property contained in the premises and used by r4ortgagor
in the rental or leasing thereof or any part thereof. The expense .
(including receiver's fees, counsel fees, costs and agent's com-
~ pensation) incurred pursuant to the powers herein contained shall
be secured hereby. Mortgagee shall (after payment of all costs
and expenses incurred) apply such rents, issues and profits re- •
ceived by it on the indebtedness secured hereby in such order as
Mortgagee determines. The right to enter and take possession of
said property, to manage and operate the same, and to collect the
rents, issues and profits thereof, ~ahether by a receiver or other-
wise, shall be cumulative to any other right or remedy hereunder ,
or afforded by lata, and may be exercised concurrently therecaith
or independently thereof. riortgagee shall be liable to accoun ~
only for such rents, issues and profits actually received by
Mortgagee. •
14. If the indebtedness secured hereby is now or hereaf-
ter further secured by chattel mortgages, security interests,
pledges, contracts of guaranty, assigtir.~ents of leases, or other
securities, or if the premises hereby encumbered consists of
more than one parcel, riortgagee may at its option exhaust any
one or more of said securities and security hereunder, or such
parcels ot the security hereunder, either concurrently or inde-
pendently, and in such order as it may determine.
15. Upon request of 14ortgagor, Mortgagee may, at its sole
option, from tir.ie to time before full payment of all indebtedness
secured hereby, make further adalnsecuredr1hereby andpremaining
however, that the total princip
unpaid, including any such advances, shall not at any time exceed
the principal sum of Ten I~lillion Dollars ($10,000,000.00).
Mortgagor shall e:cecuze and deliver to Mortgagee a note evidencing
each and every such further advance which t•?ortgagee may make, ;1
such noi:e to be payable on or beiore maturity of the indebtedness
secured hereby and to contain such terms as Mortgagee shall re-
quire. hlortgagor shall pay all such further advances wi.th in- _
terest, and the same, and each note evidencing the same, shall -
be sccured hereby. All provisions of this mortgage shall apply
to cach further advance as ~rell as to all otl~er indebtedness se-
cureci l~ereby. tJothinR herein contained, hoc•rever, shall limit the
amouni: secured by this mortqac~e if such ar.lount is increased by
advanccs madc by :•lortgagce, as herein elsec~here provided for to
protect the security. The word "Mortgagor" as used in this para-
graph, includes any successor in o~~nership of the premises.
16. No delay by riortgagee in exercising any right or
remecly hereunder, or otherti~ise afforded by laio, shall operate as
a waiver thereof or prcclude the exercise thereo~ during ~he con- #
tinuance of any default hereunder_ .?~o ~~aiver by ~lortgagee of any _
default shall constitute a waiver of or consent to suUsequent
defaults. t~o ~ailure of r!ortgagee to exercise any option herein
given to accelerate maturity of the debt hereby secured, no
forebcarance by 1'.ortgagee before or after the exercise of such
option and no withdrac~~al or abandonment of foreclosure proceed-
ings hy ltortgagee shall be taken or construed as a waiver of its
right to exercise such option or to accel~rate the maturity of- the
