Pierce Harbor Bulkhead for a distance of 955.0 feet, more or less,
to a point in the waters of the Indian River; thence run North-
westerly along a line erected at an angle of 135 degrees from South
through West to North a distance of 583.0 feet, more or less, to a
point on the existing South right of way line of Florida State
Road No. 559, as conveyed from the Trustees of the Internal Improve-
ment Fund to the State Road Department of the State of Florida
by Deed No. 19211, as recorded in Deed Book 129, at page 17, of the
public records of St. Lucie County, Florida, which point is 150
feet South of a point on the center line of the North Beach Road
Bridge which is 1036.9 feet, more or less, East of the intersection
of the extended center line of the North Beach Bridge and the East
right ot way line of the Florida East Coast Railway; thence continue
in a westerly direction along the South line of said State Road No..
559 right of way to a point where said South right of way line inter-
sects the West shore line of the Indian River; thence meandex in
a Southerly direction the West Bank of the Indian River to a point
where said West Bank of the Indian River intersects the East end
of an existing wood bulkhead on the North bank of Taylor Creek, ,
thence run Westerly along said wood buikhead for a distance of 274.0
feet, more or less, to a point where it intersects the East property
line of the aforementioned F. H. Conrad property; thence run South
9 deg. 15 min. West for a distance of 35 feet m~re ar less, to a
point which is the Southeast boundary of the aforementioned F. H.
- Conrad Property; thence run South 62 degrees 16-min. West for a
distance of 92.6 feet to the point of beginning.
LESS AI~ID EXCEPTING THEREFROM, an undivided 3/4 interest in and title
in and to all phosphate, minerals, and metals that are or may be
in, on or under the above described land and an undivided 1/2
interest in and title in and to an undivided interest in all the
petroleum that is or may be in or under the said above described
land as previously reserved by the Trustees of Che Internal Improve-
ment Fund of the State of Florida, together with the-privilege
' to mine and develop the same.
~ TOGETHER WITH all of the Mortgagor's right, title and interest
in and to the license, leave and right to take, dredge and remove
from the bottom of the Indian River East of the above described
land as provided in that certain Deed from the Trustees of the
Internal Improvement Fund of the State of Florida to DiGiorgio
Fruit Corporation dated April 9, 1947, filed April 23, 1947, in
Deed Book 134, page 130, and further,
LESS AND EXCEPTING from Parcels One A and One B above, all lands
and easements owned of record by or in the actual use and possession
of any pub.lic or quasi public body, governmental agency, railway
company or utility company for use as public roads, drainage canals
and facilities, railroads, power lines, telephone lines or other like
uses.
It is the purpose of this mortgage to convey to the Mortgagee all
of Mortgagors right, title and interest in lands of which it is
seized and possessed from Government Lot 2, Section 34, Township
34 South, Range 40 East and Government Lot 1, Section 3, Township
35 South, Range 40 East and certain submerged lands adjacent tn
and immediately East thereof as evidenced by that certain Warranty
deed from DiGiorgio Corporation to St. Lucie Packing Corp. dated
June 20, 1972, recorded June 29, 1972, in Official Records Book 203,
Page 2426, of the public ~ecords of St. Lucie County, Florida,
and referenced conveyances recited therein. ' .
