COX, his ~ ; wife, in consideration of the sum of Ten Dollars and other ~ valuable consideration, receipt of which is hereby acknowledged, ~ ~ do hereby sell, assign, transfer and set over unto THE COPPOLA COMPANY, a partnership, all of their rights under Paragraph 3 of that certain Agreement dated November 16, 1970, recorded in Official Records Book 188 page 889 of the Public Records of St. Lucie County, Florida, wherein said John L. Lester and Ruth W. Lester, his wife, and Robert R. Cox and Joan P. Cox, his wife, are Sellers and Royal Estates, Inc., a Florida corporation, is Buyer _ ~ x of ~ ~ All that part of the E'~ of Section 12, Township 34 South, ~ ~ Range 39 East lying North of the Turnpike Feeder Road, ~ and all that part of the W~ of Section 7, Township 34 ~ South, Range 40 East lying North of said Turnpike Feeder ~ Road, less 2.9 acres, described in said Agreement, in St. Lucie County, Florida; Said paragraph 3 reads as follows: "3. It is a specific condition of this transaction that Buyer f is to furnish Sellers a means of ingress and egress to the ~ Sellers remaining lands lying Northerly of the lands conveyed ( to Buyer. In this regard, Buyer agrees that it shall either € dedicate a road to the public or grant a permanent easement unto Sellers and their heirs, grantees and assigns over a road to extend from the Northerly right of way line of Turn- pike Feeder Road to the North boundary of the lands being conveyed to Buyer. Said road shall have a minimum right of way width of 100 feet throughout its lenqth. It is recognized that Buyer intends to develop the lands conveyed to it as a mobile home park and that considerable engineering work is required before said road is actually laid out by survey. For this reason Buyers agree that, until such time as the said road is actually laid out and passable, Sellers and their heirs, administrators, grantees and assigns may use the West 100 feet of the lands conveyed to Buyer as an ~ easement for ingress and egress to Sellers' lands lying northerly of Buyers lands."
