12. The Grantor, his heira or asaigns reaervea the right to place pipes or wires within
ten (10) feet of the boundariee of any lot, and ehall always have the right for himaelf, hie
heirs or aseigns as and when may be most convenient to him to enter on said lot for the
purpose of erecting, fixing, building, examining, maintaining or repairing such pipes, `
conduita, electric lighta, telephone poets and wires, drainage pipea or awales, and other ~
public servicea as in hia opinion may be deairable or neceesary to place on the ten (10)
foot etrip herein referred to; provided, however, that nothing herein ehall be constructed
to permit the division of any one owner's contiguoue parcel of land by such ten (10) foot
atrip, when auch contiguous parcel conaiete of parta of more than one reoorded lot.
13. All electrical and telephone service linea to individual lots ehall be underground
except where those main electrical and telephone tranamission linea are located on overhead
poles running on the right of way from Gilson Boad to the development proper.
14. The raising. maintainin~ or breeding of any domesticated animals or birds ahall not
be permitted on the premises; except that not more than two (2) in number of any
species of houaehold pets may be kept by the owner on the premises . Litters of dogs and/ '
or cata ehall be removed from the premises not more than one hundred twenty (120) days ~
from their birth .
15. No docks on waterways are to be built directly opposite those on the other side, ~
but are to be staggered by a minimal distance of 100 feet . Any docka are to be parallel ~
to the ahoreline and one side being directly attached to land and not more than four (4) ;

feet in width . No off-shore tie pilings allowed beyond dock . ~

16. No seawalls permitted; exception may be permitted with the use of contoured seawalls ~
to control some condition of erosion not poasible to control by other methods . Such ;
permieaion must be obtained in writing from the Grantor, his heirs or assigns. Such ~
permission will then only be given for very limited areas . ~

1?. Hauaea to have a setback from the water not less than thirty (30) feet.
18. The septic tank drain field is to be located on the lot aide away from the water
and on the side neareat the road .
19. Minimum lot size will be one (1) acre.
~ 20. In the event that the Grantee, his heirs, administrators, or assigns shall violate or
~ fail to carry out any or all of the covenants , conditions , or restrictions hereinabove provided
~ proceedings to enforce compliance therewith by injunction or other suit or otherwise may ;
be brought, at the option of the Grantor, his heirs or assigns. Any owner of other lota ~
may proceed aimilarly . No failure or omission to bring such suit or take such other ~
proceedings as may be deemed necessary ahall be held to be a waiver of any right in the
~ Grantor , his heirs or assigne , or in any lot owner to enforce compliance therewith .
~ 21. These covenants are to run with the land and shall be binding on all parties and on al~l
persons claiming under them until January 1~, 1996.
