The Grantor, hie heirs or aeaigna reaerves the right to place pipes or wires within ; ten (10) feet of the boundaries of any lot, and ahall alwaye have the right for himself, his heire or aeeigna ae and when may be moat convenient to him to enter on said lot for the purpoae of erecting, fixing. building, examining, maintaining or repairing such pipea, conduite , electric lighta , telephone poate and wirea , drainage pipee or ewalea . and other public services as in hie opinion may be deeirable or neceasary to place on the ten (10) ~ foot etrip herein referred to; provided, however, that nothing herein shall be constructed to permit the diviaion of any one owner's contiguoue parcel of land by auch ten (10) foot strip, when such contiguoua parcel consista of parts of more than one recorded lot. 13. All electrical and telephone eervice linea to individual lots shall be underground except where thoae main electrical and telephone transmiesion lines are located on overhead polee running on the right of way from Gilson Aoad to the development proper . 14. The raiaing, maintaining or breeding of any domeaticated animale or birds shall not be permitted on the premiaes; except that not more than two (2) in number of any species of houaehold peta may be kept by the owner on the premisea . Litters of dogs and/ or cata shall be removed from the premiaee not more than one hundred twenty (120) days from their birth . 15. No docka on waterway as re to be built directly oppoaite those on the other aide, but are to be staggered by a minimal diatance of 100 feet . Any docks are to be parallel to the shoreline and one side being directly attached to land and not more than four (4) feet in width . No off-shore tie pilings allowed beyond dock . 16. No seawalla permitted; exception may be permitted with the use of contoured seawalls to control some condition of erosion not posaible to control by other methods . Such permission muat be obtained in writing from the Grantor, his heirs or aasigns. Such permission will then only be given for very limited areas . 17. Houaes to have a setback from the water not lesa than thirty (30) feet. 18. The septic tank drain field is to be located on the lot side away from the water and on the aide neareat the road . 19 . Minimum lot size will be one (1} acre . - i 20 . In the event that the Grantee, his heirs , administrators , or assigns shall violate or ` fail to carry out any or all of the covenants, conditions, or restrictions hereinabove provided, ~ proceedinga to enforce compliance therewith by injunction or other suit or otherwise may ~ be brought, at the option of the Grantor, his heirs or assigns: Any owner of other lots may proceed similarly . No failure or omission to bring such suit or take such other ~ proceedings as may be deemed necesaary shall be held to be a waiver of any right in the Grantor, his heirs or assigns , or in any lot owner to enforce compliance therewith . 21.
