The Grantor, hie heire or aseigne reservea the right to place pipes or wirea within ten (10) feet of the boundariea of any lot, and ehall alwaye have the right for himself, his heirs or aseigns as and when may be most oonvenient to him to enter on said lot for the purpoee of erecting, fixing. building, examining, maintaining or repairing such pipea, conduits, electric lighte, telephone poets and wires, drainage pipee or ewalea, and other ~ public servicee ae in hie opinion may be deeirable or necessary to place on the ten (10) : foot atrip herein referred to; provided, however, that nothing herein shall be constructed ; to permit the diviaion of any one owner'e oontiguoue parcel o~f land by auch ten (10) foot f atrip, when auch contiguoue parcel conaieta of parts of more than one recorded lot. ; , ; 13. All electrical and telephone service linea to individual lots shall be underground ~ except where thoae main electrical and telephone tranamiasion lines are located on overhead ; 3 poles runrung on the right of way from Gilson Road to the development proper. # a t 14. No docks on waterways are to be built directly oppoaite thoae on the other aide, but are to be staggered by a minimal dietance of 100 feet . No seawalla permitted; exception may be permitted with the use of contoured seawalls ~ to control some condition of erosion not posaible to oontrol by other methoda . Such ~ permiasion must be obtained in writing from the Grantor, his heire or'aesigma. Such ~ permisaion will then only be given for very limited areas . ~ ~ # 17. Houaes to have a aetback from the water not less than thirty (30) feet. ~ ~ m 18. The aeptic tank drain field is to be located on the lot side away from the water ~ and on the side nearest the road . 19. Minimum lot aize will be one (1) acre. r 20. In the event that the Grantee, his heirs, administrators, or assigns shall violate or ~ ~ ; fail to carry out any or all of the covenanta, oonditiona, or restrictions hereinabove provide ~ proceedings to enforce compliance therewith by injunction or other auit or otherwise may be brought, at the option of the Grantor, his heirs or assigns. Any owner of other lots may proceed similarly . No failure or omission to bring such euit or take auch other proceedings as may be deemed necesaary shall be held to be a waiver of any right in the Grantor , hia heirs or assigns , or in any lot owner to enforce compliance therewith . 21.
