The Grantor. hie heire or assigne reaerves the right to place pipes or wires within ten (10) feet of the boundariea of any lot, and ehall always have the right for himself, hie heire or aesigns aa and when may be most oonvenient to him to enter on said lot for the purpose of erecting, fi~dng, building, examining, maintaining or repairing such pipea. ; conduits, electric lights,`~elephone poete and wires, drainage pipes or swales. and other ' public services ae in hie opinion may be desirable or neceaeary to place on the ten (10) , foot etrip herein referred to; provided, however, that nothing herein shall be constrttcted to permit the division of any one owner's contiguous parcel of land by such ten (10) foot etrip , when auch contiguoua parcel oonaiats of parts of more than one recorded lot . 13 . All electrical and telephone aervice linea to individual lots shall be underground ~ except wher~ thoae main electrical and telephone transmission linea are located on overhead . pole8 running on the right of way from Gilson Road to the development proper . - _ 14. The raiaing, maintaining or breeding of any domeaticated animals or birds ahall not ~ be permitted on the premisee; except that not more than two (2) in number of any ~ apecies of household pets may be kept by the owner on the premises . Litters of dogs and/ ~ or cata ahall be removed from the premisea not more than one hundred twenty (120) days ~ from their birth . 15. No docks on waterways are to be built directly opposite those on the other side, t sta ered b a minimal distance of 100 feet . No aeawalls permitted; exception may be permitted with the use of contoured aeawalla to control some oondition of eroaion not poesible to oontrol by other methods . Such ; permission must be obtained in writing from the Grantor, tua heirs or assigns . Such T permission will then only be given for very limited areas . ~ : 17. Aouses to have a setback from the water not leas than thirty (30) feet. ~ . ~ ~ 18. The aeptic tank drain field is to be located on the lot aide away from the water ~ and on the side neareat the road . ~ ~ 19 . Minimum lot aize will be one (1) acre . ; ~ Y 20. In the event that the Grantee, hia heira, administratora, or asaigns shall violate or 3 k fail to carry out any or all of the covenante , conditions , or reatrictiona hereinabove provided , i i proceedings to enforce compliance therewith by injunc tion or other suit or otherwiae ma y ~ ! be brought, at the option of the Grantor, his heira or aseigna. Any owner of other lots ~ ~ may proceed similarly . No failure or omiseion to bring such euit or take such other ~ ~ proceedings as may be deemed neceasary ahall be held to be a waiver of any right in the ~ Grantor , hia heirs or assigns , or in any lot owner to enforce compliance therewith . ~ ~ - - 21.
