The Grantor, his heirs or aesigr~s reservea the right to place pipea or wirea within ten (10) feet of the boundariea of any lot, and shall always have the right for himself, hie heire or aseigna ae and when may be most oonvenient to him to enter on eaid lot for the j purpose of erecting, fixiAg, building. examining, maintaining or repairing such pipes, ~ conduite , electric lighte , telephone poete and wires , drainage pipea or awalea , and other public services as in hia opinion may be deairable or neceseary to place on the ten (10) foot atrip herein referred to; provided, however, that nothing herein shall be constructed # to permit the division of any one owner'a contiguoue parcel of land by auch ten (10) foot , etrip, when such contiguoue parcel conaiats of parte of more than one reoorded lot. ~ 13. All electrical and telephone service lines to individual lots shall be underground except where those main electrical and telephone transmiseion lines are located on overhead poles running on the right of way from Gilson R.oad to the development proper . ~ II 14. The raising, maintaining or breeding of any domeaticated animal8 or birds ahall not ~ be permitted on the premises; except that not more than two (2) in number of any speciea of houaehold peta may be kept by the owner on the premiaes . Littera of dogs and/ or cats shall be removed from the premiaea not more than one hundred twenty (120) days from their birth . 15. No docks on waterways are to be built directly oppoaite those on the other aide, but are to be etaggered by a minimal distance of 100 feet. Any docks are to be parallel to the shoreline and one side being directly attached to land and not more than four (4) feet in width . No off-shore tie pilings allowed beyond dock . ~ ~ ; 16. No seawalls permitted; exception may be permitted with the use of contoured seawalls ~ to control some condition of erosion not poasible to oontrol by other methods . Such permiesion must be obtained in writing from the Grantor, fiis heirs or assigna. Such ; permission will then only be given for very limited areas . # ~ 17. Houses to have a setback from the water not less than thirty (30) feet. ~ i 3 18 . The septic tank drain field is to be located on the lot side away from the water ~ ~ 3' and on the aide nearest the road . ~ t ~ 19. Minimum lot size will be one (1) acre. ; ~ ! 20. In the event that the Grantee, his heira, administrators, or asaigns ahall violate or ' fail to carry out any or all of the oovenanta, conditione, or restrictions hereinabove provided, ; ~ proceedings to enforce compliance therewith by injunction or other suit or otherwise may be brought, at the option of the Grantor, his heira or asaigna . Any owner of other lota may proceed similarly . No failure or omisaion to bring such suit or take auch other ~ proceedinga as may be deemed necessary shall be held to be a waiver of any right in the Grantor , his heirs or assigns , or in any lot awner to enforce compliance therewith . 21.
