The Grantor, his heira or assigna reserves the right to place pipea or wirea within ~ ten (10) feet of the boundaries of any lot, and shall always have the right for himself, his heira or aesigna as and when may be moet convenient to him to enter on eaid lot for the purpose of erecting, fixing, building, examining, maintaining or repairing such pipes, conduits , electric lighte , telephone posts and wires , drainage pipea or swales , and other public services as in hia opinion may be desirable or necessary to place on the ten (10) foot atrip herein referred to; provided; however, that nothing herein ahall be constructed to permit the diviaion of any one owner's contiguoue parcel of land by auch ten (10) foot atrip , when such contiguous parcel consiata of parts of more than one recorded lot . 13 . All electrical and telephone aervice lines to individual lots shall be underground except where those main electrical and telephone transmission lines are located on overhead polea running on the right of way from Gilson R.oad to the development proper. 14 . The raising . maintaining or breeding of any domesticated animals or birds shall not be permitted on the premises; except that not more than two (2) in number of any , speciee of houaehold peta may be kept by the owner on the premiaes . Litters of dogs and/ ' or cafs shall be removed from the premises not more than one hundred twenty (120) days from their birth . 15. No docks on waterways are to be built directly opposite those on the other side, but are to be staggered by a minimal distance of 100 feet . Any docks are to be parallel to the shoreline and one side being directly attached to lanc~ and not more than four (4) feet in•width . No off-ahore tie pilings allowed beyond dock . 16 . No seawalls permitted; exception may be permitted with the use of contoured seawalls to control some condition of erosion not possible to control by other methods . Such permission must be obtained in writing from the Grantor, his heirs or asaigns. Such permiseion will then only be given for veiy limited areas . 17 . Housea to have a setback from the water not less than thirty (30) feet . 18 . The septic tank drain field is to be located on the lot side away from the water ~ and on the side nearest the road . ~ E 19 . h'Iinimum lot size will be one (1) acre . ~ ~ e event that the Grantee, his heirs, administrators, or assigns shall violate or : 20 . In th ; fail to carry out any or all of the covenante , conditions , or restrietions hereinabove provided , ~ proceedings to enforce compliance therewith by injunetion or other auit or otherwise may ~ ~ be brought , at the oprion of the Grantor , his heirs or assigns . Any owner of other lots ~ may proceed similarly . No failure or omission to bring such suit or take sueh other ~ proceedings as may be deemed necessary shall be held to be a waiver of any right in the Grantor , his heirs or assigns , or in any lot owner to enforce complia~nce therewith . w ~ ~ _ 21.
