Court. From that teatimony and the testisnony received in this case, this ~

Court concludes the follo~ing facts:
'Ihe plaintiff herein is a well driller and was hired by the defendant;
~
that the well pumped an excessive amount of sand; that the defendant requested ~
i
numerous times the plaintiff fix/repatr the well; that the plaintiff had no ~
,
equipment to repair at that particular time; that the plaintiff was awaiting 's
delivery of a new machine; that a neW velt was drilled by another; that `
;
power lines have been erected over the site of the old well; that a concrete ~
driveway has been built over WI'iich the well drilling machine should ~ot pass; ~
~
that the well as it exist is unfit for service; that certain above ground

~ fittings Were used on the second well by the defendant; that both parties are
t
~
~ agitated and aggravated and need the intervention of the Court.
? 'It~is Court concludes that the plaintiff in this case is guilty of lachea.

~ Laches is negligence or omission [o assert a right seasonably, or an unexcused

~
y delay in asserting rights during a period of time in which adverse rights to
~ the premises have been acquired under circumstances that make it inequitable
~
~ to displace such adverse rights. The offer made in open Cour~ by the defendant

~ to return the above ground fittings or its monetary e~uicy is acceptable. It
~
~
is, thereiore,
