The Grantor , his heirs or aesigna reserves the right to place pipes or wires within ten (10) feet of the boundaries of any lot, and ahall alwaye have the right for himself, hie heire or aeaigns as and when may be moat oonvenient to him to enter on eaid lot for the purpose of erecting, fixing, building, examining, maintaining or repairing auch pipes, conduite, electric lighte, telephone posts and wirea, drainage pipea or swales, and other public servicee as in hie opinian may be desirable or necessary to place on the ten (10) foot atrip herein referred to; provided, however, that nothing herein ahall be conetructed to perwit the division of any one owner's oontiguoue parcel of land by such ten (10) foot ~ strip, when such oontiguous parcel coneiets of parte of more than one recorded lot. 13 . All electrical and telephone aervice lineB to individual lote ehall be underground except where thoee main electrical and telephone transmisaion lines are located on overhead poles running on the right of way from Gilson Road to the develapment proper . 14. The raising, maintaining or breeding of any domesticated animals or birda ahall not be peraaitted on the premisee; except that not more th8n two (2) in number~of any apeciea of household pets may be kept by the owner on the premises . Littera of doga. and/ or cats ehall be removed from the premises not more than one hundred twenty (120) days from their birth . ' 15. No docka on waterways are to be built directly oppoeite those on the other side, but are to be ataggered by a minimal distance of 100 feet . Any docks are to be parallel to the ahoreline and one aide being directly attached to land and not more than four' (4) feet in width . No off-shore tie pilings allowed beyond dock . 16. No seawalls permitted; exception may be permitted with the use of contoured seawalla to control some condition of erosion not pasaible to control by other methods . Such - permission must be obtained in writing from the Grantor, his heirs or assigns. Such permisaion will then only be given for very limited areas . 1? . Houses to have a setback from the water not lesa than thirty (30) feet. 18 . The septic tank drain field is to be located on the lot side away from the water and o~a the side nearest the road . ~ 19. Miuumum lot aize will be one (1) acre. 'l 20. In the event that the Grantee, his heirs, administrators, or aesigns ehall violate or fail to carry out any or all of the covenants, conditions, or reatrictions hereinabove provided, proceedings to enforce compliance therewith by injunction or other suit or otherwise may be brought, at the option of the Grantor , his heirs or asaigns . Any owner of other lota may proceed similarly . No failure or omission to bring such suit or take such other proceedings as may be deemed necessary ahall be held to be a waiver of any right in the Grantor, his heirs or assigns, or in any lat owner to enforce oompliance therewith. ~ 21.
