12. The Grantor, his heire or assigne reaervea the right to place pipes or wiree within ~
ten (10) feet of the boundaries of any lot, and ehall always have the right for himself. hie '
heira or aseigna as and when may be awat oonvenient to him to ente•r on said lot for the
purpose of erecting, fixing, building, examining, maintaining or repairing auch pipes,
conduits , electric lighte , telephone poats and wirea , drainage pipes or swalea , and other ~
public aervices as in hia opinion may be deairable or necessary to place on the ten (10)
foot atrip herein referred to; provided, however, that nothing herein shall be constructed
to pertnit the diviaion of any one owner'e contiguoue parcel of land by auch ten (10) foot
etrip, when such contiguous parcel consista of parts of more than one recorded lot.
13. All electrical and telephone service linea to individual lote ehall be underground
except where those main electrical and telephone tranemiesion lines are located on overhead
polee running on the right of way from Gilson Road to the development proper .
14. The raising, maintaining or breeding of any domeeticated animals or birds shall not
. be permitted on the premises; except that not more than two (2) in number of any
species of household pets may be kept by the owner on the premisea . Littera of dogs and/
or cats shall be removed from the premises not more than one hundred twenty (120) days
from their birth . a
15. No docks on waterways are to be built directly ogposite those on the other side,
but are to be staggered by a minimal distance of 100 feet . Any docks are to be parallel
to the shoreline and one side being directly attached to land and not more than four (4)
feet in width . No off-shore tie pilings allowed beyond dock .
16. No seawalls permitted; exception may be permitted with the use of contoured seawalls
to control some condition of erosion not poasible to oontrol by other methods . Such
permission must be obtained in writing from the Grantor, his heirs or asaigns . Such
permission will then only be given for very limited areas .
17. Aouaea to have a setback from the water not less than thirty (30) feet. i
18. The septic tank drain field is to be located on the lot side away from the water
and on the side nearest the road .
I~~ 19. Minimum lot size will be one (1) acre.
20 . In the event that the Grantee , hia heirs , administrators , or aesigne shall violate or
fail to carry out any or all of the covenants , conditions , or restrictions hereinabove provided ,
proceedings to enforce compliance therewith by injunction or other suit or otherwise may
be brought, at the option of the Grantor, his heirs or assigna. Any owner of other lots
may proceed similarly . No failure or omiasion to bring such suit or take such other
proceedings as may be deemed necessary shall be held to be a waiver of any right in the
Grantor , his heirs or assigna , or in any lot owner to enforce compliance therewith .
21. Theae covenants are to run with the land and shall be binding on all parties and on all
persons claiming under them until January 1, 1996. -
