12. The Grantor, hie heirs or assigns reservee the right to place pipes or wires within
ten (10) feet af the boundaries of any lot , and ehall always have the right for himaelf , hie
heirs or aseigne as and when may be most oonvenient to him to enter on said lot for the
purpoae of erecting, fixing, building, examining, maintaining or repairing such pipee,
conduite . electric lighte , telephone posts and wirea , drainage pipea or awalea , and other
public services as in his opinion may be desirable or necessary to place on the ten (10)
foot etrip herein referred to; provided, however, that nothing herein ehall be conetructed
to permit the diviaion of any one owner's c:ontiguoue parcel of land by auch ten (10) foot
etrip, when such oontiguous parcel conaista of parts of more than one recorded lot.
13. All electrical and telephone service lines to individual lots ahall be underground
except where those main electrical and telephone tranemiseion lines are located on overhead
poles running on the right of way from Gilson Road to the development proper .
14. The raising, maintaining or breeding of any domesticated animals or birds shall not
be permitted on the premises; except that not more than two (2) in number of any
species of houeehold pets may be kept by the owner on the premiaes . Littera of dogs and/
or cata shall be removed from the premisea not more than one hundred twenty (120) days
~ from their birth .
15. No docks on waterways are to be built directly oppoaite those on the other side,
but are to be staggered by a minimal diatance of 100 feet . Any docks are to be parallel
to the shoreline and one aide being directly attached to land and not more than four (4)
feet in width . No off-shore tie pilings allowed beyond dock .
16 . No seawalla permitted; exception may be permitted with the use of contoured aeawalls
to control some oondition of erosion not poseible to control by other methods . Such
pernaiseion must be obtained in writing from the Grantor, his heirs or assigns . Such
pernaission will then only be given for very limited areas .
17. Houses to have a setback from the water not lesa than thirty (30) feet.
18. The septic tank drain field is to be located on the lot side away from the water
and on the side neareat the road .
19. Minimum lot aize will be one (1) acre.

20. In the event that the Grantee, his heira, administrators, or assigns shall violate or
fail to carry out any or all of the covenants , conditions , or restrictions hereinabove provided ,
proceedinga to enforce compliance therewith by injunction or ather auit or otherwise may
be brought, at the option of the Grantor, his heirs or assigns. Any owner of other lots
may proceed similarly . No failure or omiasion to bring such suit or take such other s
proceedings as may be deemed necessary shall be held to be a waiver of any right in the
Grantor , hia heira or assigns , or in any lat owner to enforce compliance therewith .
21. These covenants are to run with the land and shall be binding on all parties and on all
persons claiming under them until January 1, 1996 .
