12. The Grantor, hia heira or assigns reserves the right to place pipes or wirea within
ten (10) feet of the boundaries of any lot, and shall always have the right for himaelf, his
heirs or assigns as and when may be moat convenient to him to enter on eaid lot for the
purpose of erecting, fixing, building, examining, maintaining or repairing such pipea,
conduits , electric lighta , telephone poats and wirea , drainage pipes or swales , and other
public servicea as in his opinion may be deairable or neceaeary to place on the ten (10)
foot atrip herein referred to; ,provided, however, that nothing herein ehall be conetructed
to permit the division of any one owner's contiguoua parcel of land by such ten (10) foot
atrip , when such contiguous parcel consists of parts of more than one recorded lot .
13 . All electrical and telephone aervice linea to individual lots ahall be underground
except where those main electrical and telephone transmisaion lines are located on overhead
polea running on the right of way from Gilson Road to the development proper.
14 . The raising. maintaining or breeding of any domeaticated animals or birde shall not
be permitted on the premisea; except that not more than two (2) in number of any
speciea of houaehold pets may be kept by the owner on the premiaes . Litters of dogs and/
or cats shall be removed from the premises not more than one hundred twenty (120) days
from their birth .
15. No docka on waterways are to be built directly opposite those on the other side,
but are ~to be staggered by a minimal distance of 100 feet . Any docks are to be parallel
to the shoreline and one side being directly attached to land and not more than four (4)
feet in width . No off-ahore tie pilings allowed beyond dock .
16 . No seawalls permitted; exception may be permitted with the -uae of contoured seawalls
to control some condition of erosion not possible to control by other methods . Such
permiasion muet be obtained in writing from the Grantor, his heirs or assigns. Such
pez~nission will then only be given for very limited areas .
17. Houaea to have a aetback from the water not less than thirty (30) feet.

; 18. The septic tank drain field is to be located on the lot side away from the water
~ and on the side nearest the road .

~ 19 . 14linimum 2ot size will be one (1) acre .

~ 20. In the event that the Grantee, his heirs, administrators, or assigns shall violate or
~ fail to carry out any or all of the covenante, conditions, or reatrictions hereinabove provided,
~ proceedings to enforce compliance therewith by injunction or other suit or otherwise may
~ be brought, at the option of the Grantor, his heirs or assigns. Any owner of other lots
~ may proceed similarly . No failu-re or omission to bring such suit or take such other
~ proceedings as may be deemed neceasary shall be held to be a waiver of any right in the
~ Grantor, hia heirs or assigna, or in any lot owner to enforce oompliance therewit .

~ 21. These covenants are to run with the land and shall be binding on all parties and on all
~
~ persons claiming under them until January 1, 1996.
