HomeMy WebLinkAbout1496 SCHEDULE"A" COVENANTS AND RESTRICTIONS OF WIDE WATERS SUBDIVISION It ia mutually understood and agreed by and between the parties hereto that thie conveyance is made aubject to the following restrictione and limitationa, which are intended to be and ahall b~ taken as covenants to run with the land, and which are intended to be and shall be taken as conditions of thia conveyance and one of the expreas coneiderations thereof as follows: . 1. Lots in the aubdivision known as the Wide Watere shall only be uaed for single family reaidential purposea . ~ 2. No atructure shall be erected , altered , placed or permitted to remain on any building site other than one detached single family dwelling not to exceed two atories in height, a gueat house , private garage , and other outbuildinga incidental to reaidential use of the premises . 3. No residential building ahall be constructed or erected on any one lot or combination of lots unless such building shall coat at least ~30 , 000 . 00 . Such residence shall have at least fifteen hundred (1,500) square feet of floor space for living area, exclusive of the area of any carport, attached private garage. patio, utility room or guest house. 4. The main roof of the dwelling ahall not have a pitch less than 3 in 12 . The pitched roof area shall normally be covered with cement shinglea or wood shingles; only exceptions may be given by Grantor in writing upon inspection of house plan for compatibilit.y with the area . Exceptions for uae of other materials will be considered only in the case of a roof with a distinctive and/or unuaual design . , 5. No house shall be painted white that has a white or light grey "roof . Exception may be made on plan approval only, providing elaborate trim conaideration has been designated of a contrasting color . No house shall be painted pink . 6. The plans and specificationa of all buildinga to be erected on the land herein conveyed ; shall be compatible with other homes in the area and they together with the plot plan shall 4 be submitted in advance to the Grantor, his heirs or aasigna, and approval thereof~ € obtained in writing before any work on said building shall start . : ~ ~ 7. Garages ahall be for the use only of the occupants of the residence of the lot on which ~ it is located; they may be attached or detached, but may not have entrances facing t e ~ front atreet. ~ ~ 8. No outbuildinga , garage , shed , tent , trailer , or temporary structure of any kind shall ~ ~ be erected , constructed or permitted previous to oommencement of permanent residential conatruction or used as temporary or pernaanent residential purposes . No trucka or trailers (excluding boat trailers) shall be kept on a residential lot unless under a roofe storage ~ ~ area or with adequate side shielding to create concealment , such as a carport or garage; provided, However, that the provisions hereof shall not apply to any maintenance and/or ~ business vehicles and equipment owned by Grantor and associated in his business, kept ~ on lots owned by him or on Park areas within the Subdivision . A pleasure boat or boat ~ trailer or habitable motor vehicle may be kept on the lot providing it is parked behind t e ~t~ back building line of the residence . No boat, houaeboat or other water vehicle shall be used for temporary or permanent residential purposes . ~ 8. All laundry or clothing placed outside to air or dry shall be within an enclosure _ - affording effective concealment . 10 . All garbage and trash containers , oil tanka , water pumps and tanks , and bottled gas t'~ tanks shall be placed underground or in walled in areas so that they shall not be visible from the surrounding properties . No unsightly atructures ahall be permitted for this _ = purpoae . 11.
