HomeMy WebLinkAbout1506 12. The Grantor, hia heira or assigns reserves the right to place pipes or wirea within
ten (10) feet of the boundaries of any lot. and ehall alwaye have the right for himself, his
heirs or aasigne as and when may be most convenient to him to enter on said lot for the
purpose of erecting. fixing, building, examining, maintaining or. repairing such pipea,
conduits. electric lights, telephone posts and wirea, drainage pipea or awalea, and other
public services as in his opinion may be desirable or neceseary to place on the ten (10)
foot atrip herein referred to; provided. however, that nothing herein ahall be constructed ~
to permit the diviaion of any one owner's contiguous parcel of land by such ten (10) foot
strip , when such contiguous parcel consists of parta of more than one recorded lot .
13 . All electrical and telephone service linea to individual lots shall be underground
except where those main electrical and telephone transmission lines are located on overhead
poles running on the right of way from Gilson Road to the development proper.
14. The raising, maintaining or breeding of any domesticated animals or birda shall not _
be permitted on the premises; except that not more than two (2) in number of any
species of household pets may be kept by the owner on the premises . I.itters of dogs and/
or cats shall be removed from the premises not more than one hundred twenty (120) days
from their birth .
15. No docks on waterways are to be built directly opposite those on the other aide,
but are to be staggered by a minimal distance of 100 feet . Any docks are to be parallel
to the shoreline and one side being directly attached to land and not more than four (4) a
feet in width . No off-shore tie pilings allowed beyond dock . ~
16. No seawalls permitted; exception may be permitted with the use of contoured seawalls
to control some condition of erosion not possible to control by other methods . Such
permission must be obtained in writing from the Grantor, his heirs or assigns . Such
permission will then only be given for very limited areas .
17. Houses to have a setback from the water not less than thirty (30) feet.
18 . The septic tank drain field is to be located on the lot side away from the water
i and on the side nearest the road . .

; 18 . Nlinimum lot size will be one (1) acre .

` 20. In the event that the Grantee, his heirs, administrators, or assigns shall violate or
~ fail to carry out any or all of the oovenants, conditions, or reatrictions hereinabove provided, ~
~ proceedings to enforce compliance therewith by injunction or other suit or otherwise may
~ be brought, at the option of the Grantor, his heirs or assigns. Any owner of other lots
s may proceed similarly . No failure or omission to bring such suit or take such other
~ proceedinga as may be deemed necessary shall be held to be a waiver of any right in the
~ Grantor . his heirs or assigns , or in any lot owner to enforce compliance therewith .

~ 21. These covenanta are to run with the land and shall be binding on all parties and on all
~ persons claiming under them until January 1, 1996.
