SANDT, et ux., Defendants. / FINAL JtJDGMENT THIS ACTION was tried before the Court on the 29th day of March, 1974. On the evidence presented, the Court finds that on May 12, 1970, the Defendant, Eric P. Sandt, executed an application for insurance with the Plaintiff, Prudential Insurance Company of America, and that in reliance thereon, the Plaintiff issued to the Defendant, Eri~ P. Sandt, its Certificate of Insurance wherein the Defendant became insured under that certain Policy of Group Insurance Number P15-378046, issued by the Plaintiff to S.J.S. Drywall Company, Inc., the employer of the Defendant, Eric P. Sandt. Subsequent ~ F to the issuance of said coverage, the Defendants presented E 6 a claim for benefits to the Plaintiff for the incurrence of ~ _ Y certain medical and hospital expenses arising from Defendant, ~ - ~ Carol E. Sandt's hospitalization at the Indian River Memorial ~ ~ Hospital, Vero Beach, Florida. Thereafter, the Plaintiff ~ learned of the existance of r?edical history of the Defendant, Carol E. Sandt, which was contrary to the application issued ~ ~ by the Defendant, Eric P. Sandt. The claim was denied by the ~ ~s: ~ Plaintiff, Prudential Insu=ance Company of Ai~erica and it ~ ~ ~ instituted the nresent suit for rescission of the Certificate of Insurance issued to the Defendant, Eric P.
