ConFlict exists tioi-ch la;n~oa Shiabuildinq & Enqin~~ering Corp. v.
~dams, 132 Fla. 419, 181 So.403 (1933) o In the Ta.;~Da Shi~buildin~
case, thz emnl~yer had ;~ot co:nplied w~ tz tne t~rms an3 conditior_s _
of Section 4, Chapter 6~83, La~as of Florida 19? 3, in e<i~ploying a
16-year-old b4y ~aho ~•~as 'ci lled ~rhi le ~•~orking for t:~~ corporation.
lhis Court found that th~ e.*nplo~~e~'s failure to co~ply with the
c:zild la'~or la:~s and the youth' s death stated a cause of action.
As the District Cour~ in this case determined, -the statute involved
in the Tampa Shinbuildin~ case was comparable to the statute involved
in th? case ~'i..,]„~dice? providing that employers of minors be required
to procure an employr.ient certificate and lteep it available for state
inspectors. The District Court also stated well the holding of ~he
Ta~npa Shi~buildinct case :
"In effect th~ Tanpa Shipbuilding case
imposed on an em~loyer civil liability
for personal injuries totally without
~ regard to fault, where a child was
~ employed in violation of the statutes
; there involved and an injury resulted
~ from the employment." ~
