Any vorporation into which the Corporate Trus- ~ tee may be merged or with which it may be vonsolidated, or any ~ corporation resulting from any merger or oonsolidation to which ~ the Corporate Trustee shall be a party, or any corporation suc- i ceeding to the business of the Corporate Trustee, shall be the . successor of the Corporat•e Trustee hereunder, provided such ; corporation shall be eligible under the provisions of Section ~ 18.6, without the exscution or filing of any paper or any ~ further act on the part of any of the parties hereto, anything herein to the oontrary notwithstanding. 18.11. The Individual Trustee shall be subject to the follo~~ing provisions : (a) All rights, powers, duties and obligations conferred or imposed upon the Trustees shal•1 be conferred or imposed solely upon, and shall be exercised and per- ~ formed solely by the Corporate TrusYee despite the plural ~ reference, except that if.and to the extent that under ~ applicable law, the Corporate Trustee shall not be competent ~ or qualified to exercise or perform such rights, powers, ~ duties and obligations, the same shall be exercised and ~ 4 performed by the Individual :rustee. To the extent ~ that under such applicable law the Individual Trustee shall ~ not be competent or qualified to exercise or perform such ; ~ rights, powers, duties and obligations, the same shall be ~ exercised and performed by the trustee or mortgagee, as the : ~ case may be, designated in the applicable Individual t•:ortgage ` ~ as if named herein as one of the Trustees hereunder. _ ~ _ i (b) Except as otherwise required by applicable 4 ~ law, no right or power granted by this Indenture to the - ~ Individual Trustee shall be exercised by him alone unless he ~ ~ shall have obtained the written consent of the Corporate ; N~: Trustee to do so. ~ (c) The Ind~vidual Trustee may, at any ti~re, by an instrument in writing, constitute the Corporate Trusf_ee - as his agent or attorney in fact, with full po~~er arid author- ` ity, to the extent permitted by law, to do any act and exercisp - any discretion authorized or permitted to him.
