recording, filing, re-recording, re-filing taxes, fees and olher charges to the '

11.4 Loniv ExrE~sES. To the extent permitted by the la~vs of the j
state in ~vhich the Mortgaged Property is situated, Mortgagor shall pay all ~
costs and expenses in connection with the preparation, execution, delivery, ~
recording, and performance of the Security Documents, including, but not ~
~ limited to, fees and disbursements of counsel appointed by 11'Iortgagee to ~

prepare the loan documents, recording costs and expenses, stamp and
~ other taxes, surveys, appraisals and policies of tide insurance.

; 11.5 NO REPRESE:~~IATION BY I~ZORTCAGEE. By aCCept1I]gOI' 1PPI'OVIIlg
~ anything required to be observed, performed or fulfilled, or to be given to
~ ~ Mortgagee, pursuant to the Security Documents, including (but not limited ~
~ to ) any officer's cercificate, balance sheet, statement of profit and loss or ~
E other financial statement, survey, appraisal, insurance policy or any in-
~ spection report under ti;e Loan Agreement, Mortgagee shall not be deemed
r to have warranted or represented the sufficiency, legality, effectiveness or ;
~ legal effect of the same, or of any term, provision or condition thereof, and ~
~ such acceptance or approval thereof shall not be or consdtute any warranty
~ or representation with respect thereto by Mortgagee.
~ 11.6 NOTICE. All notices, demands, requests and other communica
~ tions required under the Security Documents and the Note shall be in
~ writing and shall be deemed to have been properly given when deposited
k~ in the United States mail and sent by United States first class mail, postage
- prepaid, addressed to the party for whom it is intended at its address set
forth in the preamble hereof. Any party may designate a change of address '

- by written notice to the others, given at least ten (10 ) days before such
- change of address is to become effective. !

11.7 MORTGAGEE'S RIGHT TO PERFORM THE OBLIGATIONS. If Mort- `
gagor shall fail to make any payment or perform any act required by the
Note or the Security Documents, then, at any time thereafter, without
: notice to or demand upon l~iortgagor, except as herein provided, and with-
r:~ out ~vai~~ing or releasing any Obligation or Event of Default, ~Iortgagee
