j At the time appellants filed their motion to consolidate appeals
~ on A ril 15, 1974, the court was not advised that the appeal in Case No..

73-1043 had been fully perfected and as a result the motion was con-
sidered and approved administratively on the basis of representation
contained therein that consolidation would avoid duplication of effort;

the status of Ca.se No. 73-1043 having now been brought to the court` s i
attention and it appearing that consolidating of Case No. 73-1043 with
interlocutory appeal in Case No. 74-428 has created unnecessary con-
fusion and will not save unnecessary judicial labor, it is ordered sua _
sponte that this court's order of April 23, 1974 consolidating the afore- ~ F.

said cases is hereby vacated and set aside, and said cases shall proceed ~

to final disposition separately and apart from one another unless here- f

after ordered to the contrary; it is further
