O R D E R
This cause coming on to be heard on the 6th day of May,
1974, on plaintiff's motion to dismiss, motion for more definite
statement and motion to strike heretofore filed in this cause,
and the Court having heard arguments of counsel and being advised
in the premises, it is hereby
ORDERED AND ADJUDGED that plaintiff's motion to dismiss
and motion for more definite statement be and the same hereby
are denied.
IT IS FURTHER ORDERED AND ADJUDGED that plaintiff's
~ motion to strike be and the same is hereby~granted, as follows:

l. The allegations of Paragraph 10 of the counterclaim
filed herein are stricken.
2.~ That portion of Paragraph 14 of the counterclaim
filed herein is stricken beginning with the word "that" at the ~

end of line 2 of said paragraph and ending with the word "counter- ~
defendant", the same being the last word of line 11 of said
paragraph, so that said Paragraph 14 is amended to read as follows:
"14. That the defective merchandise supplied
by the counterdefendant was knowingly supplied to the
counterclaimant and is warehoused~by the counter-
~ - claimant, and in the counterclaimant's possession."
3. The allegations pertaining to damage to ~eputation
in the business community appearing in Paragraph 15 of said ~
