The Grantor. his heirs or aseigns reaervea the right to place pipes or wires within ten (10) feet of the boundaries of any lot . and ehall alwaye have the right for himself , his heirs or aseigns ae and when may be ~ost oonvenient to him to enter on said lot for the purpose of erecting, fixing, building, examining, maintsining or repairing euch pipea, conduits, electric lighta, telephone posts and wires, drainage pipee or ewales, and other public servicee as in 2iis opinion may be desirable or necessary to place on the ten (10) foot strip herein referred to; provided, however, that nothing herein shall be conetructed to permit the division of any one owner's contiguous parcel of land by such ten (10) foot atrip , when such contiguous parcel c~onsieta of parts of more than one recorded lot . 13 . All electrical and telephone service linea to individual lots ahall be underground except where those main electrical and telephone tranemiseion linee are located on overhead poles running on the right of way from Gilson Road to the development proper . 14. The raiaing. maintaining or breeding of any domesticated animals or birda Shall not be permitted on the premises; except that not more than two (2) in number of any speciee of household pets may be kept by the owner on the premiaea . Litters of dogs and/ or cats ehall be removed from the premiaes not more than one hundred twenty (120) days from their birth . 15. No seaaalls permitted; exception may be permitted with the use of oontoured aeawalle to control some condition of erosion not poseible to control by other methods . Such percnission must be obtained in writin~ from the Grantor, his heirs or aseigns. Such permission will then only be given for very limited areas . 1? . The aeptic tank drain field is to be located on the lot aide away from the water and on the side nearest the road . i 19 . Minimum lot size will be one (1) acre . 20. In the event that the Grantee, lus heira, administrators, or assigns shall violate or fail to carry out any or all of the covenants, oonditiona, or reatrictiona hereinabove pmvided, proceedinga to enforce compliance therewith by injunction or other suit or otherwiae may be brought , at the option of the Grantor , his heirs or asaigns . Any owner of other lots may proceed similarly . No failure or omission to bring such suit or take such other proceedings se may be deemed necessary ahall be held to be a waiver of any right in the Grantor , his heirs or assigna , or in any lot owner to enforce compliance therewith . 21. Theae covenants are to run with the land and ahall be binding on all parties and~ on all persons claiming under them until January 1, 1996.
