CONTRACT. OF SALE - Page Three
Seller as liquidated and agreed upon damages. zf the defects
are not cured within a reasonable time,.the Purchaser shall
have the option of paying the balance of the purchase price~
notwithstanding the defects, or of requesting and receiving
from Seller the deposit paid down under this Contract.
6. Upon receipt of the balance of the purchase price
within the~time allawed, the Seller will promptly execute and
deliver to the Purchaser a good and sufficient Warranty Deed,
containing all the usual common law covenants of title, con-
veying the aforementioned pro~erty to the Purchaser in fee
simple.
7. Either party failing to comply with the terms of
this Contract will pay all expenses, including a reasonable
attorney's fee, incurred by the other party because of that
fai lure .
8. Ad valorem taxes for the year 1973 will be pro-
' rated between the parties as of the date of closing. At

i closing, Seller agrees to pay for documentary stamps on the ,
~ deed, recording the mortgage, abstract continuation, intangi.b le
tax on the mortgage and Purchaser agrees to pay for prepara-
tion of note and mortgage, documentary stamps on mortgage
note, recording deed, examination of abstracts of title and
survey, if required by Purchaser.
9. Closing of this transaction is contingent upon

the follawing events to be performed by Purchaser at Pur-
chaser's expense:

(a) Vacating the platted street right_of way
~ for Seventh Avenue lying adjacent to and Westerly
~ .
~ of Blocks 5 and 10 of OCEAN VIEW SUBDIVISIOV,
~ and vacating the platted street right of way

~ for Eldorado Street lying adjacent to and Wester y
of Blocks 6 and 11 of OCEAN VIEW SUBDIVISION, as
~ per plat thereof on file in Plat Book 6, page 61,
public records of St. Lucie County, Florida;

~ (b) Purchasing the follawing described property
from CONEMAUGH, INC. or from WAYNE U. SINES, JR.,
record title awner:
