AMENDED ORDER
THIS COURT previously entered an Order on the 24th day of
May, 1974, pertaining to all pending Motions filed by the.
Defendants in this cause and having heard said Motions on the
8th day of May, 1974, and having received correspondence from
the attorneys for the Defendants Loveday and Bananas, Inc.,
dated May 28th; 1974, in reference to paragraph three (3) of
' the Order and having also received correspondence from

; attorneys for the Plaintiff noting that a scriveners error
had been made and having reviewed its,own notes of said hearing:
IT IS HEREBY ORDERED AND ADJUDGED that ~paragraph three (3)
of the Order of May 24, 1974 be amended to read as follows: .
3. As to the Defendants Loveday and Bananas, Inc.,
the Motion to Dismiss Counts III and IV as they
might pertain to the Defendants Loveday and
" Bananas, Inc, are granted; and the Motion to
Dismiss Counts I and II are denied.
The Plaintiff will have ten (10) days from the
date of receipt of the~Amended Order in which
~ to serve an Amended Complaint if he so desires.
