PARTIAL RELEASE OF MORTGAGE 4a~Q3 KNOW ALL MEN BY THESE PRESENTS: WNEREAS, FIRST NATIONAL CITY BANK, a national banking associa- tion organized under the laws of the United States of America, is now the owner and holder by assignment of the following mortgages and the notes secured thereby, to-wi t: A mortgage deed, executed the 14th day of October, 1970, by Outdoor Resorts of America, Inc. to Continental Mortgage Investors, a Massachusetts Business Trust, securing a5,100,000.00 and recorded in Official Record Book 187, Page 2405, et seq., Public Records of St. Luc~e County, Florida, encumbering certain lands in tt. Lucie County, Florida therein more-particularly described; as amended by Modification of Mortgage Deed, dated October 4, 1972, amending the sum secured by an additional principal indebtedness of 51,112,392.00 and also encunbering other lands in Polk County, Florida, which Modification of Mortgage Deed was recorded in Official Record ~Book 207, Page 867, et seq., Public Records of St. Lucie County, Florida, and as further amended by Mortgage Modifica- tion and Extension Agreement, dated June 27, 1973 and recorded~ in Official Record Book 216, Page 265, Public Records of St. Lucie County, Florida; and ~ WHEREAS, Outdoor Resorts of America has requested First National ~ City Bank to release the property hereinafter described, being a part of the mortgaged premises, from the lien and operation of said mortgage; NOW, THEREFORE, First National City Sanlc, in consideration of the premises and the sum of Four Thousand Seven Hundred Twelve and DOLLARS ` 4712.50 , t e receipt whereof is hereby acknowledged, - do~s remise, release, quit claim, exonerate and discharge from the lien and operation of said mortgage, unto the said mortgagor, its ` successors and assigns, that certain portion o'~ the property conveyed ` by said mortgage more particularly described as follows: ~ Lot 195 ~ ~ Section II - ` in that certain condominium known as Outdoor Resorts ~ ~ of America at Nettles Island, according to plat ~ ~ of Nettles Island Project recorded in Plat Book 16, ~ ~ Pages 1 through 1(j) inclusive, and Declaration of Condominiian recorded in Official Record Book 186, ~ Page 2720, as last amended in Official Record Book ~ -192, Page 820, public records of St. Lucie County, F1 ori da - ~ i TO HAVE AP~D TO HOLD the same, with the appurtenances, unto the ~ said Mortgagor, its successors and assigns, forever freed, exonerated and discharged of and from the lien of said Mortgage; provided, always, nevertheless, that nothing herein contained shall in anywise impair, ~ alter or diminish the effect, lien or encunbrance of the aforesaid • ~ Mortgage on the remaining part of said mortgaged property not released hereby, or any of the rigFts and remedies of the holder thereof. ~ ~ . ; ~ ~ ~ ~ ~ _ - ~ ~ . 1 . ~ ~ ~ ~ R ~ PAGf b00K ~ . ~ ; ~ ~ ~ ~ ~ ~ ~ _ w s ~ - _w. a.
