~j directors control the Homeowners Associatioa, no assessment ±n
excess of $10.00 can bQ made, even with approval of the a+emb~r-
ship.
The Homeowners Association can assess, in addition to
the above $10.00, amounts necessary to provide utili~ty service4
. including, but not limited to, garbage collection and sewage .
~i disposal. ~
! The Homeowaers Association caa further ~harge interest
~ at 1Q~ per annum, plus a late charge of $1.50 for late payments
~ due hereunder or under paragraph la, h~reof.
The Homeowners Association shall have a 2ien oa the
unit of any member who fails t4 pay any assessment when due for
the amount of the assessment and any late ch~r~e and interest.
~ Said lien shall attach immediately upon the payment not being
~ made when due, but shall be inferior to any liens under para-
~ graph 10 hereof.
12. No trucks, or ot~er commercial vehicles with a rated
load capacity of one (1) ton or more shall be permitted to be
parked in WINDMILL VILLAGE BY THE SBA, UNIT 2, for a period of
more than four (4) hours, unless the same is present and necessary
in the actual coastruction or repair of any building.
13., All garbage and trash containers, oil tanks, water
pumgs aad tanks, and bottle gas tanks must be underground or place
in wal2ed ~n areas in order tbat they will not be visible from
surrounding praperties. No unsightly structure shall be permitted
for this purpose, and all such structures must~be approved by the
Homeowners Associatioa.
I) 14. There is hereby reserved to the Grantor, its successors
~ aad assigns, a utility easement over the rear 6 feet of the lot
~r being conveyed hereby. The rear of the lot shall be deemed the
( i portion of the lot furthest from the street line.
~ ~ 15. Grantee herein, by acceptance of this Deed, shall be-
r come a meu~be~• U~ Ho~aeowners Associatian. Such merabersh2p sha12
~ automatically pass to any grantee, assigns, successor or heir
~ upon their acquiring title to the property herein conveyed. ~
Resignation as a member will not affect any obligations by Grantee
~ under the provisioas of this Deed.
16. All leases, initially for a period of over one year, or
which extead over one year by renewal or tenaacy at will or suffer
ance, shall require approval of Homeowners Association. If the
~ original lease is over one year, the approval shall be before the
lease is executed. If the initial lease is less than one year,
~ but continues as aforesaid, over one year, the approval shall be
obtained wi+~ia 30 days after the first year has expired. The
Horaeowners ` ociation approval will not be arbitrarily or un-
reasonably Nithheld. The Homewowners Association will approve or
disapprove a lease within 30 days of the time of receiving such ;
request, supported by such information as it may reasonably ~
~ require. If Homeawners Association does aot approve or disapprove :
~ the application within that period of time, it shall be presumed '
~ the application was approved.

17. In case the grantee, their heirs, legal representatives,
_ successors or assigns, shall violate, or fail to carry out any or
aIl of the stipulated conditions, praceedings to enforce complianc
