YJITNESSETH: WHEREAS, Developer is the owner of the ~eal property described in Article II of this Declaration and desires to create thereon a planned residential comrnunity with permanent parks, recreational areas, open s,~aces, and other common facilities; and, to this e~d desires to subject the reul }xoperty described in Article II together with such additions as may hereofter be made the~eto (as provided i~ Article II) to the covenants, restrictions, easements, servitudes, charges and liens hereinafter set forth, each and ali of which is and for the benefit of said property and each awner thereof~ and, WHERE.AS, Developer has deemed it desirable, for the efficient pres~rvation of the vafues and amenities in said community, to create an agency to which should be delegated and assigned the powers of maintaining and administering the community properties and facilities ond administering and enforcing the co•oenants and restrictions and coliecting and disbursing the assess- ments and cho~ges hereinafter creoted; and, ~ , WHEREAS, Developer has or will immediately cause to be incorporated under the r-Ia v of the State of Florida, as a not-for-profit corporation, MIDPO~T WEST P~20PERTY OWNERS' I ~ i ' ASSOCIATION, INC., for the pur}~ose of exercising the functions a~oresai ; ~ NOW, THEREFORE, the Developer declares thot the real praperty described in Article 11, and such additions thereto as may hereafter be madE pursuant to A~ticle I) hereof, is and shall be held, transfered, sold, conveyed ard occupied subject to the covenants, restrictions, eosements, servitudes, charges and liens (sometimes referred to as "covenants ond restrictions") herein~ter set forth. . ARTICL~ I. DEFINITIONS Section 1. The following words when used in this Declorotion or any Supplementa! Declaration (unless the context shafl prohibit) shall have the following meanings: .
