any Supplemental Declor~tion under the provisi~r:s of A~ticle II hereof,
"Common Properties" shall mean and refer to those areas of land
specifically described on Schedule A attachzd hereto ~nd by this reference made o part hereof,
intended to be devoted to the common use and enjoyment of tl~e owners of The Properties and suc~
other real properties or interests therein, whetlier or not improved, as are conveyed to and owned by
t~~e Association,
(d~ "Lot" shall mean and refer to any plot of land shown upon any
recorc3ed subdivision map of The Properties with the exception of Common Prooerties as heretofore
daf i ned .
(e) "Dwellin~ Unifi" sl~all mean and refcr to any portiot~ of a building
situated upon The Prooerties designed and intended for use and occupancy as a residence by a single
family, whetlier that portion shall constitute an apartment, a condominium unit, a cooperative
apartment or unit, an apartment in a duplex, a to.vnhouse shariny a porty-v.a11 H~ith other improve-
ments, an unafitached single family home, or otherwise constitute a residence whose cusYomary use

(y) "Owiner" shall mean and refer to the record awner, whether one or
more persons or entities, of the fee simple title to any Lot or Dtivelling Unit, but, notvii~hstanding
any applicable theory coi~cerning a m~rtgage encumbering any Lot or Dwelling Unit, shall not mean
