HomeMy WebLinkAbout0368 i~ aid thareof to mortgoc~e said properties, In the event of a default upon any such murtgage, the Ir:nders' rights hereunder shall incl~de but not be limited to o right, after toking possessio~ of svch ~:coperties, to charge admission and othcr fees as a condition to continued enjoyment by the Members and to open the enjoyment of such properties to the public; • ~ (b) The right of the Associotion to talce such steps as are reasonably necessary to protect the obovedescribed praperties against foreclosure; _ (c) The right of the Association, as provided in its Articles and Bylo~vs, to suspend the enjoyment rights of any Membcr for any psriod during which any assess:nent remains unpaid, and for any perio~ not to exceed thirty (30) doys for any infraction of its publisned ~ules and reculofiions; (d) The right of the Association to cl~arge reasonable odmission ond other fees for the use of the Common Properties; . (e) The right of individual Members to the exclusive use of parking spaces ; a as provided in Section 5 of this Article; (f) The droinage an~! tzmporary retention of starm woter run-off ~ses of rhe Common Properties referred to in Section 3 of this Article; and, t (g) The right of the Association to dedicate ar transfer ofl or any part of - - ; the Co:nmon Properties to which it has title to any public ~gency, authority, or utility for su4h _ ; purposes and subject to such conditions as may be agreed to by the Memb~rs, provided that no such ~ dedication or fronsfer or dztermination as to the purposes or as to the conditio~s there, shall be ~ effective unless an instrument sig~ed by Membe~s entiFied fio cast two-thirds (2/3; of the votes of ~ each class of inem5ership has been recorded, agreein~~ to su~h dedication, tronsf:~r, purpose or condition, and unless written notice ot the proposed a~ree:nent and action thzreun~er is sent to ~ every member at least nineiy (9~) days in advance of any action taken.
