EXTERIOR MAIt~lTENANCE
Section I, Exte~ior Maintenance. In additio~ t.; :~~aintenonce u~c~n Common
Properties, the Association may provide exterior maintenance uoon each lot and Dwelling Unit
which is s~bject to assessment unde~ Article V he~eof, as fallo~+s: paint, repoir, replacement
and care of roofs, gutters, downs~outs, exterior building surfaces, trees, shrubs, grau, walks, .
and other exterior improvements, Such exterior maintenance shall be performed pursuant to
agreement with an Owner or by the Association upon its determination thot an Qwner has failad
to mai~tain the exterior of his Lot or Dwelling Unit in accordance with the general standards
of The Properties, after reasonable notice to the Owner specifying such failure. in the case of
a condominium or cooperative, theOwn~r, for the p~rpose of t{iis Article VIII, sholl be deemed
to be the condominium ossociation or coope~ative association as the case moy be, having the
authority and responsibility for the painting, repc~iring, replacement, care of roofs, gutters,
downspouts, exterior buiiding surfoces, trees, shrubs, grass, walks and other exterior improve-

ments to the extent that such condomini~~m or cooperative association has such res~onsibility.
Section 2. Assessment of Cost. The cost of such exterior maintenance shal! be
f assessed against the lot or D~velling Unit upon ~vhic~-~ such maintenance is done and shall b~ added

~ to and beccme par~ of the annua! maintenance assessment or charge to which such lot or Dwelling

Unit is subject under Article V hereof and, as part of such annual ass~ssment or charge, it shall
be a lien and obligation of the Otvnzr and shall become due and payable in all resoects as
provided in Article V hereof. Provided that the 8oard o~ Directors of t~z Association, ~v{ien
establishing the anruai assessment a~ainst eac~ lot or Dvielling Unit for any assessment ycar as
required under Article V hereof, may add thereto the estimated cost of the exterior maintEnance
fo~ that year but, thereafter, shall mtike such adj~~stment wifih the Owner as is necessory to reflect
the actual cost thereof. In the case of coo~eratives or condominiums und w{~en the obligation for
~ exterior maintenonce is thtit of the cooperativ~ ossociation or condominiurr~ ossacivtion in the
o-~ aapro~riate cas~, the Soard of Directors of the Association muy assess the cost of such exterior

maintenance herein provided for against soid condominium association or coopernti~~e association
