HomeMy WebLinkAbout1575 ~ functions to serve its members; however, the Homeowners Associa- tion cannot assess more than $10.00 per unit per month without 75~ vote of the entire members. fi~rther, as long as the initial directors control the Homeowaers Association, no assessment in excess of $10.00 can be made, even with approval of the member- ~ ship. ~i The Homeowners Association can assess, in addition to ~I the above $10.00, amounts necessary to provide utility sarvices - including, but not limited to, garbage collection and sewuge ;i aisposal. ! The Homeowners Association can further charge iaterest ~ at 10~ per aunum, plus a late charge of $1.50 for late payments 4~ due hereunder or under paragraph 10, hereof. , ~ The Homeowners Association shall have a lien on the ~ unit of any member who fails to pay any assessment when due for the amouat of the assessment and any late charge and interest. Said lien shall attach immediately upon the payment not being made when due, but shall be inferior to any liens under para~=~-- graph 10 hereof. 12. No trucks, or other commercial vehicles with a rated load capacity o.f one (1) ton or more shall be permitted to be parked ia WINDMILL VILLAGE BY THE STA, UNIT 2, for a period of more than four (4) hours, unless the same is present and necessary in the actual construction or repair of any building. ~ 13. Al1 garbage and trash c~ntaiaers, oil tanks, water pumps and tanks, and bottle gas tanks must be underground or place in walled-in areas in order that they will not be visible from surrounding groperties. No unsightly structure shall be permitted for this purpose, and all such structures must be approved by the Homeowners Associatioa. 14. There is hereby reserved to the Grantor, its successors - aad assigns, a utility easement over the rear 6 feet of the lot being conveyed hereby. The rear of the lot shall be deemed the ~ portion of the lot furthest from the street line. i ~ 15. Grantee herein, by acceptance of this Deed, shall be- ~ come a member of Homeowners Association. Such membership shall ! ~ automatically pass to any graatee, assigns, successor or heir upon their acquiring title to the property hereia conveyed. ~ ~ Resignatioa as a member will not affec~ any obligations by Grantee under the provisions of this Daed. 16. All leases, initially for a period of over one year, or which extend over one year by renewal or tenaacy at will or suffer ~ ance, shall require approval of Homeowners Association. If the ! origiaal lease is flver one year, the approval shall be before the i lease is executed. If the initial lease is less than one year, ~ but continues as aforesaid, over one year, the approval shall be obtaiaed within 30 days after the first year has expired. The ~ Homeowners Association approval will not be arbitrarily or un- ~ reasona.bly withheld. The Homewowners Association will approve or disapprove a lease aithin 30 days of the time of receiving such request, supported by such informatioa as it may reasonably ~ ~ require. If Homeowners Association does not approve or disapprove ~ ~ the application within that period of time, it shall be presumed = ~ the application was approved. ~ ~ ~ ~ 1?.
