EXECUTIVE ORDER NUMBER 74- 35

WHEREAS, citizens of Fort Pierce, Florida, Nineteenth
Judicial Circuit, have made allegations concerning the misconduct
of inembers ot the Fort Pierce City Police DepartMent as such
conduct relates to the treatment of citizens and prisoners, and
to investigatior.s conducted by said department, and
WHEREAS, the Hanorable RORERT STONE, State Attorney of
the Nineteenth Judicial Circuit, made presentations of these
matters beforz the St. Lucie County Grand Jury, and
i~HEREAS, it appear~ as a result of sain presentations,
that a cor.flict of interest has developed, and .
W~-;EREAS, the Honorable ROBERT STONE informs the Governor
that due to the close working relationship of his office with

the Fort Piercz City Police Department and others, to avoid any
appear3nce of ir~propriety or conflict of interest, he requests

~ the assiunr.~ent of an outsine State Attorney, and
i WHE~EAS, dLe to the nature an~ subject of possible grand
~ jury indictn.en~s, the said H~norable ROEERT STO~E may be called

as a witness for the Sta~e Florida, and

WHEREAS, it is in the best interest of the State of
Florida and justice can best be serve~ by the assignment of the
below named State Attorney pursuant t~ Section 27.14, Florida `
Statutes;
NOW, THEREFOF.E, I, RE~BIN O'D. ASKES;1, as Governor of
Flerida, pursuar.t to the Constitution and Laws of Florida, do
hereby promulgate the following Executive Order effective

Ninth Judicial Circuit, hereinafter referred to as the "Assigneci
