This cause came on to be heard the 15th day of July, 1974
;
on the following motions: Plaintiff's Motion to Amend the Complaint,
Defendant's Motion for Judgment on Pleadings and Plaintiff's Motion
~ to Compel Party to Answer Oral Interrogatories on Deposition, and
the parties being represented by counsel, and the court being fully
advised in the premises, it is therefore,
ORDERED and ADJUDGED, as follows:
1. That the plaintiff's Motion to Amend Complaint is
hereby granted with leave for the plaintiff to file his Second
Amended Complaint within_ten days from date of hearing, and the
defendant shall have ten days from receipt of plainti=f's Second
i
Amended Complaint to file his responsive pleading.

2. The defendant's Motion for Judg~nt on Pleadings is
hereby denied.
3. The plaintiff's motion to compel answers to oral
interrogatories is granted. The defendant shall answer the first
question as rephrased below:
"Mr. Taylor, did Mr. Sutherland act as your
attorney prior to the execution, or at the
execution, of the contract described as Plainti~s
E~ibit 1 for identification?"
AlI other questions as certified are proper questions, and the
defendant is dire~ted to answer same, under oath, within ten days
~ from date hereof.
4. It becomes apparent that this cause is not at issue
at this time, and therefore it would not be properly tried on the
24th day of July, 1974 as previously ordered by this court. The ~
order setting this case for trial is hereby rescinded, and the
