Before me, the undersigned officer in and for the State
of Florida at Large, personally came and appeared ROBERT G.
McINBRNEY, who, first duly cautioned and sworn, deposes and says:
1. That Affiant, together with his wife, Jeanne J.
McInerney, acquired title to the following described real property
on May 28, 1971, viz.:
The South 180 feet of the North 430 feet
(as measured along State Road Highway A-1-A)
lying Easterly of said State Highway A-1-A,
of Government Lot 2, Section 12, Township
38 South, Range 41 East.
2. That Affiant and his said wife entered into immediate
possession of the above described property as of the date of
acquisition of the same and have remained in full and complete !

' occupancy as fee simple title owners of said lands to the present
f date, in a manner adverse to the interests of all others.
3. That since May 28, 1971 no members of the public have
utilized the above described lands for access to the waters of the }
Atlantic Ocean from State Road A-1-A excPpt with the permission of
Affiant or his said wife. ;
4. That any tracks or other physical evidence of routes
~ of access over and upon the above described lands from State Road ;

A-1-A to the waters of the Atlantic Ocean have been created by :

Affiant and his said wife, their licensees and invitees. i

5. That Affiant and his said wife have at no time granted
an easement to any third party o ver and upon said lands.
