BRACKETT whose mailing address is P. O. Box 965, Vero Beach, Florida - 32960, as party of the second part: WITNESSETH: That Jack F. Fielding (v~rhose~name was changed from Jack Finkelstein by order of the Civil Court of the City of New York, County of New York bearing date of August 4, 1965), died May 17, 1971 leaving his Last Will and Testament which was duly admi~ted to probate and record in the Surrogate's Court in and for the County of New York and State of New York on May 26, 1971 with an authenticated copy thereof having been admitted to probate and record in Dade County, Florida, by order dated October 16, 1972; that said Will nominated as Executor thereQf Herbert B. Claster, a resident of Ne~v York, who renounced his right to serve as Ancillary Executor in the State of Florida in favor of Charles H. Finkelstein, a brother of the decedent, who, was there- after, duly appointed and qualified as Ancillary Administrator cum testamento annexo of the Will of Jack F. SUBJECT to mortgage from Jack Finkelstein and Yolande • Francoise Finkelstein, his wife, to New England Mutual Life Insurance Company, dated January 28, 1949, recorded ` in Mortgage Book ?2, at page 473 of the public records of St. Lucie County, Florida, securing the sum of $50, 000. 00 as the same was modified and extended by Agreement between ~ mortgagor and mortgagees dated December 5, 1963, re- ~ corded in O. R.
