NOW, There{ore, the condition of the obligation is such that it said Principal shall well and faith-
tully do and pertorm the things agreed by said Principal to be done and periormed according to the
( ierms of said contract; and shall fully indemni{y and save harmless the Owner lrom all cost and
, damage which he may suffer by reason of iailure so to do, and shall fuily reimburse and repay the
! Owner all outlay and expense which the Owner may incur in making good any such default; and
j shall promptly pay all lawful claims oi sub-contractors material men and laborers, for labor pertormed
j and materials furnished in carrying forward, performing or completing ot said contract; we agreeing
~ and assenting that this covenant shall be tor the benefit of any material man or laborer having. a just
claim, as w el! as for the Obligee herein; then this obligation shall be void; otherwise the same shall
remain in iull force and efleci; it being expressly understood and agreed thtt the liability oi the
Surety Ior any or all claims hereunder shall in no event exceed the penal amount of this obligation
as herein stated_ .
And the said Surety, for value received, hereby stipu:ates and agrees that no change, extension
of time, alteration or addition to ihe terms of the contract or to the work to be perlormed thereunder or
the specitications accompanying the same shall in any wise effect its obligations on this bond, and it
does hereby waive notice oi any such change, extension oi time, alteration or addition to the terms ol
the centract or the work or to t~e spaciiications. •
