~This ~:ause came on to be heard on the Motion of the Respondent
to modify and set aside the Order entered on March the 22nd, 1974 and
Notice having been given to ths Plaintiff of a hearing Lo be held on
said Motion on April 2~, 1974, on May 28, 1974 and on July 22, 1974,
and the Plaintiff having failed to appear in Court~or to file any
answer or defenses to ~he said Motion; and the Respondent having
stated to the Court that the Plainti_ff had advised him that the minor
children were to be known as RICHARD C. McKINLEY and DOIIGLAS ANDREW

McKINLEY and not as RICF~RD C. SMITH, JR. or DOIIGLAS ANDREW SMITH,
and that the said RIC~iRD C. ~iITH was not the father of the said
children and that she refus~d to p~rnit the Respondent to talk to the
children, and that the said DON1~ A. Mci~INLEY is living with A. R.
McKINLEY without the benefit of marriage in the State of Ohio with
the said minor children above named, and the Court having heard argu-
ment of counsel for the Respo*~dent and being fully advised in the
premises, it is thereupon
_3 pRDERED AIv'D ADJUDGED as follaws:
1. That the Order entered by this Court on the 22nd day of
March, 1974 be and the same is hereby rescinded and is null and void.
