In the event the Husband r~moves the citrus trees and fails to fill in the holes to ground level and sod the same as hereinabove set out,then the said Errol S. Willes, $squire, is to deliver the Assign~~eent of Mortgage to the Wife and the Wife is relieved from the obligation to execute and deliver the Assignment ~ of Mortgage as set out in Paragraph 4 hereof but shall retain a one-half interest in the Mortgage fran Anthony G. DiMicco and Elvira DiMicco, his wife, as tenants in common with the Husband. ?n the event the Husband removes the citrus_trees and fills in the holes to ground level and sods the same as hereinabove set out, . , then in that event, the sai.d Errol S. Willes, Esquire, attorney for the Wife, shall deliver over to the Husband the Assignment of ' Mortgage executed by her pursuant to Pa,~agraph 4 above. 9. The Husband, RAYMOND F. D~AY, shall pay the utility bills and the mortgage payment on the property located at 642 Bolin Court, Port ~t. Lucie, Florida through August 7, 1974; that the Wife, NORMA L. DAY, shall be entitled to receive and have the benefit of any utility deposits made by the parties on the marital dwelling hereinabove described. 10. The Wife, NORMA L. DAY, be and she is hereby author- ized to assume her former name of NORMA L, WENTZEL and to use the ~ same in all respect as if said marriage had not intervened. I1.
