OPINION AI~ID FINAL JUDGMENT
ROBERT F. BRERETON and JEAN A. BRERETON, his wife, filed
suit against KENNETH T. PERONA and PAMELA PERONA, his wife, see]~ing
dissolution of an alleged partnership and an accounting. Trial ~aas _
held on May 14, 1974, May 16, i974, June 28, 1974, and July 5, 1974.
At the conclusion of all the evidence, Pamela Perona was dismissed
~ as a defendant after the court determined that sne did not have or
~ -
~ claim any ownership interest in the business known as Ken Peron~ .
Oldsmobile. In lieu of oral arguments, the attorneys for the
Plaintiffs and the remaining Defendant have filed writt~n briefs.
Robert F. Brereton cont~nds that he is a partner in the
~
business known as Ken Pzrona Oldsmobile by virtue of an oral partner-
ship agreement between himself and I~enneth T. Perona. Under Brereton's
version of the agreement he was to have a present 25% interest in
the business in return for a capital investment of $25,~1n0=nn. Pe~~n3

~ on the other hand contends that the agr~ement was not for a present
~
partnership, but was for a po~sible future partnership five years
hence. According to Perona, thej agreed that if Brereton success-
fully performed as general maiiager of Ken Perona Oldsmobile for five
years, then in that event, he would have the option of purchasing
