HomeMy WebLinkAbout0646 AItTICLE IV If any person should renounce or disclaim any or all ~ of his or her interests hereunder, then tY?e succeeding or alter- nate interests hereunder shall be accelerated or substituted. Accordingly, all of the provisions of this Agreement shall be construed as though such person had predeceased the Settlor, ex- cept any provision that may be necessary to preserve any interest of such person which he or she has not renounced or disclaimed. ARTICLE V A. Any trustee may resign at any time by a aiyned in- atrument delivered to the successor trustee, or if none by a signed instrument filed with the trust records after givi.ng writ- ten notice, specifying the effective date of the resignation, to the Settlor or after her death to the beneficiary or beneficiar- ies, at the time of giving notice,.of the current trust income. ; B. 1. If the last suYviving individual Trustee dies, ~ resigns, refuses or is unab3e to act, the beneficiary or benefi- ciaries of the current trust income shall ~ppaint as Trustee by ~ an instrument in writing filed with the trust records a corpora- ~ tion, authorizecl under the laws of the United States or of any ; state to administer trusts and having total capital, surplus and undivided profits of at least One Million Dollars. 2. In the event that the last surviving individual : ; Trustee has becor?e unable to dischar.ge his duties as Trustee by ~ reason of accident, physical or mental illness, prociressive or iatermittent physical or mental deterioration or other similar cause, as certified by two independent licensed physicians af- firming that each has examined such Trustee and that each has concluded, based upon such examination, that such Trustee is un- able to discharcte his duties as Trustee, said Trustee shall thereupon cease to be Trustee in the sar~e manner as if he had a~~ ~ ~ -s- ~ ~ , - _ _ .
