T~iIS CAUSE having come on for final hearing upon the s
. ;
complaint and answer filed herein and the Court having heard ~
te~timony of witnesses produced by both parties and the arguments
of counsel, and the Court being otherwise~fully advised in the
premises, the Court finds as follows:
1. That the Court has jurisdiction of the~parties and
of the subject matter.
2. That the equities of this cause are with the plaintiffs,
Bruce M. Proske and Renneth Proske, d/bJa Proske Paving, and
against the defen~ants, Harry Midelis, Catherine Midelis and
Nicholas H. Midelis. -
3. That the allegations contained in the complaint have
been proven by competent evidence and that there is naw due and
owing to the plaintiffs from the defendants, Harry Midelis, Catherine
Midelis and Nicholas H. Midelis, on the mechanic's lien described '
in the complaint, the sum of ~io Thousa~id Four Hundred and 1~aelve
Dollars ($2,412.00) together with interest thereon as allowed by.
lac,r from the 17th day of May, 1974 to September 3, 1974 in the
amo~t of Forty-Three .Dollars ($43.00) , and attorney's fees payable
to Spencer B. Gilbert, attorney for the plaintiffs herein in the
amount of Five Hundred Dollars ($500.00) which the Court finds to
be a reasonable fee in this cause; costs and Court costs in this
action in the amount of One Hundred Twelve Dollars and Fifty Cents
($112.50) for a total sum of Three Thousand Sixty-Seven Dollars
and Fifty Cents ($3,U67.50) and all such sums are secured by the lien
herein foreclosed.
