AFFIDAVIT
STATE OF FLORIDA
COUNTY OF ORANGE
Before me, the undersigned authority, personally appeared
DONALD K. MOE, wha after beinq 3uly cautioned and sworn deposes
and says : - ;
That Affiant has personal knowledge of the facts set forth ~

in this affidavit and is President of Florida Ma~d Citrus _ `
Corporation, a Florida Corporation.
By deed of conveyance dated August 15, 1963, Florida Maid
Litrus Corporation conveyed to The First National Bank at
Orlando as Trustee, those certain lands situate in St. Lu~ie ~

County, Florida legally described as: ~
Sections 6(LESS Nortn 500 feet), 7, 18, 19, :
and 30, LESS right-of-way for turnpike and '
canal, Township 34 Sauth, Range 38 East.
Said deed having been filed for record August 16, 1953 and re-
corded in Official Record Book 69, page 5 of the public records
' of St. Lucie County, Florida.
That there appears of record on the public records of
~ St. Lucie County, Florida in Official Record Book 91, at page

382, a grant of easement dated May 11, 1964, affecting a part
or parcel of the lands last above described, between Minute
Maid Citrus Corporation, a Florida Corporation, as Grantee and
The First National Bank at Orlando, a Florida banking corpora-
tion as Trustee, under a certain trust agreement dated July 31,
1963.
That affiant h*as one of the parties to the agreement dated
~ July 31, 1963 referred to in said grant of easement, is familiar
with its content and the parties thereto, and knows of his own
personal knowledge that The First National Bank at Orlando as
Trustee was not one of the parties to said agreement. That the
persons named as parties in said agreement were F. Burton Smith,
