THIS PSRMIT is issued this ~3 day of ~r a~~, 19~,
by tt~e NORTH ST. LUCIB RIVSR WA18R MANAGL~tBNT DISTRICT, a Drainage District
~ organized and Qxisting under the General Drainage Laws of the State of Florida
whose addresa is Pt. Pierce, Florida 33450, hereinafter referred to as the
"district", to F`I.ORIDA GAS TRANSI~QSSION C01~4'ANY, a Delaware corporation, whose
address is P.O. Box 44, ilinter Park, Florida 32789, hereinafter referred to
as "FLORIDA"; ~

NpW, T~REFORB, the District does herewith grant to FLORIPA the right
to construct, maintain, inspect, operate, repafr, replace, change the size of
or remove a pi~ieline or pfpelic~es and appurtenances for the transportation of _
~natural gas, together with the right of irigress and egress to and fran the same,
ove; on and across the right of ways, caaals and ditches of the District, all
situated in St. Iucie County, Florida, acd knowa, described and referred to in
the records and files of said District as canals and laterals #43, #44, and #45;
provided, however, that as a condition subsequent~to maintaining the rights
herein granted, FLORIDA agrees to and With the District as follows~
1. That the rights herein granted shall be limited to a Width of
~ 30 feet for canal crossings, extending 15 feet on either side of each pipeline ~

I as constructed.
~ 2. That the crossings of the rights of way, canals and ditches of
the District are in conformance with the plan and profile draWings of each
crossing attached hereto and made of part hereof. '
3. That should the operations of the District require a future .
change or adjustment of the pipelines as herewith permitted, then the same
will be changed or adjusted by FLORIDA at its expense Wi.thin six (6) months
after receipt of notice in writing fram the District to FLORIDA.
That this Permit is subject al~ays to the paramount right of the
District to keep and maintain its functions and operations as are now or-may
be hereafter suthorized by law.
4. ltiat FLORIDA assumes full responsibility for the construction,
operation and maintenance of the pipelines.
