HomeMy WebLinkAbout2827 Pierce Farms Water Management District but was removed therefrom by decree of the Circuit Court of St. Lucie County, Florida, pursuant t~ ay-r~enent between the Fort Pierce Farms Drainage District, and the then owners of said land, dated August 30, 1945, recoraed in aeed Book 118, page 522 of the public records of St. Lucie County, Florida; and ~•7HEREAS, pursuant to the terms of said agreem~nt and in exchange for an annual sum evuivalent to 7-1/2¢ per acre, the then landowners were granted the limited privilege of draining the waters naturally and actually falliny upon said land into the drainage system maintained by the first party; and WHEREAS, second party intehds to develop or has developed its hereinabove described property for citrus production or for other improved use and will require for such development adequate drainage of surface waters other than waters actually falling on said real property and specifically including waters brought upon said land by improved irrigation methods; and WHEREAS the drainage requirements of second party cannot rightfully be met under the existing agreement dated August 30, 1945, recorded in Deed Book 118, page 522 of the public records of St. Lucie County, Florida, as the same pro- vides for the discharge only of water which naturally falls upon second party's said lands into the drainage syste~ operated and maintained by first party; and ' WHEREAS, second party has reauested first party to allow it to drain all of said Zands owned by it on a,~ unrestricted basis ir.to the drainage system operated and maintained by first party, which request has been granted by first party on certain terms, conditions and upon the consideration hereinafter stipu- lated; -2- FEE.
